The Primary Medical Provider (PMP) shall not discriminate against Patient 1st enrollees in determining appointments. The following appointment standards should be used as a guideline for all patients: ...
(2) Appointments for urgent care must be scheduled within no more than 48 hours;
(3) Scheduling decisions concerning urgent care must include identification of the patient's immediate medical necessity for receiving care within 48 hours, and;
(4) Waiting times at service locations for scheduled appointments shall not exceed one hour under normal circumstances.
For specialty referrals, PMP shall provide: ...

6. Urgent care appointments for the beneficiary shall be within two (2) days, when the beneficiary presents symptoms of sudden or severe onset, but do not require emergency room services. For an urgent medical condition, the Contractor shall make a medical evaluation of the recipient or cause such an evaluation to be made within twenty-four (24) hours with appropriate treatment and follow-up as deemed medically necessary. Treatment for non-urgent medical problems must be available within three (3) weeks. This standard does not apply to appointments for routine physical exams, nor for regularly scheduled visits to monitor a chronic medical condition calls for visits to occur less frequently than once every three weeks." The PCD or PCD's practice will maintain office visiting hours at least four days per week for at least twenty-five hours per week for enrollee appointments, unless this provision is waived by OVHA if necessary to assure access to services and providers. Participating PCDs who work in a practice on a part-time basis will inform OVHA of the times they are available to see patients.
7. The PCD agrees to the appointment waiting times standards set out in Rule 10, promulgated by the Department of Banking, Insurance, Securities, and Health Care Administration (BISHCA).
